Terms of service

1. The seller

This website is operated by Ahsan Ghafar, an individual trading as a sole trader under the name Spirits Select. References to “we”, “us” and “our” mean Ahsan Ghafar trading as Spirits Select.

Address: 19 St Margarets Road, Ward End, Birmingham, B8 2BA, United Kingdom

Shopify provides the technology used to operate the store. Your contract for products purchased from this website is with the seller identified above.

2. Scope and eligible destinations

These terms govern consumer purchases from our website. Our initial sales market is Australia, with prices and payments in Australian dollars (AUD).

We may also accept orders for delivery within the United Kingdom when that destination is enabled at checkout. Available destinations, the applicable currency and delivery charges are shown before you place an order.

You must have the legal capacity to enter into the transaction and provide accurate information needed to process and deliver your order.

3. Products and descriptions

We sell physical products described on the relevant product pages, including drinkware and related accessories. Specifications, quantities, materials and any product-specific limitations should be checked before ordering.

Product images illustrate the items offered. Screen settings may affect how colours appear, but this does not permit us to supply goods that materially differ from their description.

Products must meet the standards required by applicable consumer law. General website wording does not override a specific description or representation that forms part of your purchase.

4. Placing and accepting an order

Before submitting an order, you can review your products, delivery details and total price and correct errors through checkout. Submitting the order confirms your obligation to pay the amount displayed.

We accept your order when we send an order confirmation email confirming acceptance. The confirmation records the details of your purchase. Please retain it together with the policies applicable at the time of ordering.

If we cannot accept or fulfil an order, for example because an item is unavailable or payment cannot be authorised, we will notify you promptly and refund any payment collected for the unfulfilled order. We will not substitute a materially different product or charge an additional amount without your agreement.

Any action taken after a contract has been formed remains subject to your statutory rights and our obligations under that contract.

5. Prices, payments and additional charges

Australian orders are priced and charged in AUD. The checkout identifies the currency, products, delivery charges and taxes that we are required to collect before you commit to payment.

Optional charges require your express agreement. Payment is processed using the methods available at checkout and may be subject to the payment provider's authentication procedures.

Import duties, import taxes and customs handling charges legally payable by the customer and not already collected at checkout are the customer's responsibility. This does not transfer to you a tax collection or payment obligation that the law places on us.

Your bank or payment provider may apply its own currency conversion charges if your account uses a different currency.

6. Fulfilment and delivery

Products are sent directly from China by a third-party supplier. Processing takes approximately 2 to 3 days. Shipping generally takes 7 to 15 days after dispatch. These periods are stated in days, not working days.

The delivery information agreed for your particular order takes priority over general estimates. Items may arrive in separate parcels.

We remain responsible for our obligations to you even though a supplier or carrier carries out fulfilment. Our Shipping policy explains tracking, delivery problems and the remedies available for late or missing orders.

For UK consumer purchases, unless another delivery period has been agreed, goods must be delivered without undue delay and no later than 30 days after the contract is made.

7. Changes, cancellation and refunds

If you notice an error in your order, contact us promptly. We will try to accommodate a correction before dispatch, but a requested operational change may no longer be possible once processing or shipment has progressed. This does not remove a statutory cancellation right.

Our Return and refund policy explains our 30-day dissatisfaction policy, UK statutory cancellation rights and remedies for faulty, incorrect or undelivered goods.

We do not require physical return after an approved refund or a valid statutory cancellation. Commercial refund conditions do not restrict remedies required by law.

8. Consumer protection

Nothing in these terms excludes or restrict rights under the UK Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 or other applicable mandatory law.

For purchases covered by the Australian Consumer Law, statutory consumer guarantees apply. Depending on the nature of a failure, these may entitle you to a repair, replacement, refund and compensation for reasonably foreseeable loss or damage.

Our commercial refund period does not determine how long statutory consumer rights last.

9. Appropriate use of the website

You must not use the website for fraud, unlawful activity, unauthorised access, distribution of malicious software or interference with its security or operation.

If an account is provided, keep its access details secure and tell us if you suspect unauthorised use. We may restrict access where reasonably necessary to address security threats or unlawful conduct, without removing existing rights relating to purchases already made.

10. Website content and external services

Intellectual property rights in website content remain with their respective rights holders. You may use the website to browse and make purchases and retain copies of your transaction documents. Other uses require permission where applicable law requires it.

External websites and services may have their own terms. These do not replace our responsibilities as the seller or reduce your statutory rights.

11. Responsibility for loss

We are responsible for loss or damage for which applicable law makes us liable, including foreseeable loss caused by our breach of contract or failure to exercise legally required care.

Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, breach of mandatory consumer guarantees or any other liability that cannot lawfully be excluded or limited.

Supplier difficulties, carrier delays or events outside our reasonable control do not remove your rights to cancellation, reimbursement or other remedies where the law provides them.

12. Complaints

Send complaints to support@spiritsselect-co.com with your order details and a description of the issue. We will investigate and explain our proposed resolution.

When communicating the outcome of a complaint, we will provide information about any applicable alternative dispute resolution arrangement that we are required to offer by law or contract. This does not restrict your right to seek independent advice or bring proceedings before a competent court.

13. Governing law and jurisdiction

These terms and the sales contract are governed by the laws of England and Wales.

This choice does not deprive you of mandatory protections available under the law applicable to you as a consumer, including the Australian Consumer Law and relevant protections for consumers in Scotland or Northern Ireland.

The courts of England and Wales may hear disputes, but this is not an exclusive jurisdiction clause that prevents a consumer from bringing proceedings in another court available under mandatory law, including an appropriate court in their place of residence.

14. Changes and interpretation

The terms applicable to your purchase are those in effect when your order is accepted. Later changes will not retrospectively reduce rights under an existing order.

If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. A delay in enforcing a provision does not waive a legal right.

Nothing in these terms overrides information or commitments that form part of your contract under applicable consumer law.
